About NCLC

The National Chamber Litigation Center (NCLC) is a membership organization that advocates fair treatment of business in the courts and regulatory agencies.  NCLC provides litigation support and advocates on legal and regulatory issues on behalf of the U.S. Chamber and other organizations to challenge anti-business laws.

Before initiating litigation, NCLC seeks the advice of its board of directors and six legal advisory committees: Administrative and Constitutional, Environmental, Labor and Employment, Strategic, Securities Law, and California Litigation. Members of the advisory committees include nationally prominent in-house counsel and private practitioners. They review requests for case involvement and identify the issues that guide NCLC's ambitious litigation strategy throughout the year.

Although it is an affiliate, NCLC receives no financial assistance from the U.S. Chamber of Commerce.  NCLC depends solely on membership dues to support its program.

Membership in the National Chamber Litigation Center is open to individuals, firms, and corporations engaged in business or a profession in the United States, and to associations representing any group of such individuals, firms, or corporations.

Our Approach
The Litigation Center recognizes that successful legal advocacy must be practiced in a variety of ways.  NCLC's effectiveness as business' advocate in the courts stems from its comprehensive four-part litigation program:
  • First, NCLC initiates litigation as a party plaintiff, taking on difficult cases that individual businesses might be reluctant to file or that no single business could fight alone and going head-to-head against federal and state government agencies on behalf of the business community.

  • Through its amicus curiae practice, NCLC presents unique and compelling legal arguments and policy perspectives that can often surpass the help that the lawyers for the involved parties are able to provide.  An NCLC friend-of-the-court brief is a valuable tool in persuading courts to rule in favor of business.  Even the Chief Deputy Clerk of the U.S. Supreme Court has praised the quality of amicus briefs filed by NCLC on behalf of the Chamber.

  • NCLC's moot court program assists a company's own litigation preparation by conducting complete 'trial runs' prior to oral argument. Initially designed to assist inexperienced counsel, these invaluable practice sessions are even used by veteran practitioners.

  • Media relations is NCLC's final component, ensuring the accurate portrayal of the business point of view in news stories on business-related legal issues and helps the public understand that pro-business decisions can benefit everyone.
