It is important the U.S. Sentencing Commission overturn a guideline calling for companies to waive their attorney–client privilege.  It is just another way for ambitious prosecutors to stack the deck against businesses – and try to win easy settlements.  The right to consult with an attorney freely and without government intrusion is a cornerstone of basic due process.  If people cannot trust the confidentiality of their legal advisors – they will be much less likely to raise and address problems – such as complying with laws and uncovering fraud.  The U.S. Chamber of Commerce will fight to keep lawyers advice private.  We will take this campaign to Congress, the White House, the Justice Department, the SEC and if necessary – the courts.
